Summary

This presentation will define decision-making capacity, including key concepts and terminology, and explain when guardianship is needed. Illustrations of how to examine capacity, including an evaluation of functional elements, will be presented.  Topics include potential causes of incapacity, optimizing/restoring capacity, and family conflicts.  There will also be discussion of types of guardianship in New York State, who can make these determinations, and responsibilities and limitations of guardians.  Throughout, discussion of ethical dilemmas will help illustrate ethical principles.

About the Presenter

Dr. Lynn A. Schaefer is a board-certified clinical neuropsychologist and Director of Neuropsychology at Nassau University Medical Center.  She is a fellow of the APA and National Academy of Neuropsychology. Her professional interests are in the remediation of neurobehavioral disorders, such as brain injury and dementia; educational outreach; and in the determination of decision-making capacity.  She is co-editor of the book, "A Casebook of Mental Capacity in U.S. Legislation: Assessment and Legal Commentary," and co-author of “Working with the Brain in Psychology: Considering Careers in Neuropsychology,” published by Routledge.

CE Credits: 1.0 CE credit (APA/NYSED) available. Completion of an evaluation and post-test are required in order to receive credit.
